Jakarta – Revisi UU KPK (Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Korupsi) antara lain mengatur pembentukan dewan pengawas.
Pengamat politik dari Political and Public Policy Studies Jerry Massie menilai, dewan pengawas memang sangat diperlukan untuk mengawasi kinerja KPK.
“Yang perlu diperkuat yakni peran KPK sebagai lembaga Ad Hoc. Bagi saya perlu juga ada lembaga pengawas yang mengawasi tugas KPK karena selama ini tidak ada yang mengawasi lembaga ini. Bukan tidak mungkin ada permainan di tubuh KPK sendiri,” kata Jerry, di Jakarta, Minggu (08/09/2019) seperti di lansir jppn.com.
Jadi, kata dia, dewan pengawas kerjanya mengawasi bahkan kalau perlu memeriksa KPK jika terlibat gratifikasi, suap, dan menyalahgunakan kekuasaan.
“Yang penting juga saat OTT uang itu dikemanakan? Perlu juga transparansi dalam hal ini. Apalagi saat menyita uang dan barang-barang koruptor harus diketahui Kejagung, Kepolisian, OJK, LSM, dan wartawan agar bisa menyampaikan ke publik,” katanya.
Jerry menilai tanpa kontrol, maka kinerja KPK tidak maksimal. Untuk “Auxiliary State Body” perlu ada pengawas.
Menurut dia, bisa ada dua opsi, yakni melibatkan mantan pimpinan KPK atau pensiunan Polri, kejaksaan atau MA. Polri saja ada yang mengawasi yakni Kompolnas apalagi KPK.
“ASN korupsi diperiksa KPK, polisi korupsi diperiksa KPK tapi seandainya KPK melakukan korupsi siapa yang periksa? Maka, dewan pengawas yang akan memeriksanya,” kata Jerry.
Namun, kata dia, terkait penyadapan tidak perlu diubah lagi aturannya karena aturan terkait penyadapan sudah ideal.
“Berbahaya bila penyadapan dipersulit. Memang publik dikejutkan tiba-tiba DPR mengambil langkah untuk merevisi UU ini kendati sudah diusulkan pada 2017 lalu. Ini terlalu dilematis saat seleksi capim KPK sedang dilakukan,” katanya.
Ke depan yang perlu digodok dan dikaji adalah hal yang substansial yakni LSM antikorupsi menjadi mitra KPK dan membuka jaringan kerja di setiap daerah.
“Bahkan, kalau bisa penyidik KPK jangan ditampilkan di publik lantaran bisa terancam keselamatannya,” ujar Jerry.
Ia menambahkan, Presiden Joko Widodo perlu turun tangan untuk meredakan pro dan kontra revisi UU KPK. “Presiden juga sangat menentukan revisi UU KPK ini,” kata Jerry. ( *)
