Poso – Hakim tunggal Pengadilan Negeri (PN) Poso, Hariyanto Mamonto menolak permohonan gugatan praperadilan tersangka kasus dugaan pencurian sawit mantan Bupati Morut MA. Penolakan ini dibacakan dalam sidang praperadilan yang berlangsung di PN Poso.
Kepala Bidang Hukum Polda Sulteng Kombespol Saptono selaku kuasa hukum termohon melalui Akp Moh. Hamka membenarkan keputusan PN Poso yang menolak secara keselurusan praperadilan terhadap Polres Morowali Utara dalam kasus dugaan curi sawit tersebut.
“Jadi Pra 05 2021 pemohon pak MA keputusannya yang pertama menolak permohonan Pra peradilan pemohon secara keseluruhan,” ujarnya, Rabu (12/1/2022).
Hakim Hariyanto Mamonto menimbang dan menilai rangkaian penyidikan oleh kepolisian terkait kasus dugaan pencurian sawit yang melibatkan mantan Bupati MA sudah sah sesuai Standar Opersional Prosedur (SOP) yang berlaku pada institusi Kepolisian.
Hakim Haryanto Mamonto juga kemudian membebankan biaya perkara praperadilan ini kepada pemohon. “Tanggal 3 Januari 2022 dilaksanakan sidang, putusannya kemarin tanggal 11 Januari 2022,” ujarnya.
Sementara itu, kuasa hukum MA menanggapi putusan Pra Peradilan ini, Merdiyansah mewakili tim mengatakan pihaknya saat ini masih menunggu salinan putusan PN Poso terkait hasil sidang Praperadilan tersebut.
“Pada prinsipnya kami sedang menunggu salinan putusan resmi untuk bisa membuat tanggapan resmi, seperti itu pak,” ujar kuasa Hukum Pemohon kepada media via sambungan telpon
Pra Peradilan ini adalah langkah hukum yang dilakukan MA setelah Polres Morut melakukan penahanan, dan memproses laporan dugaan pencurian buah sawit milik PT Kurnia Luwuk Sejati di Blok 275 dan Blok 275 A Desa Momo, Kecamatan Mamosalato.
Dalam kasus ini terhadap tersangka MA diterapkan pasal dengan pasal 362 Jo Pasal 55 ayat ( 1 ) ke 1e KUHPidana dengan ancaman 5 tahun penjara. (Hen/Van)
