Jakarta-Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional (ATR/BPN) RI, Nusron Wahid, menjawab isu jual-beli pulau yang menjadi perbincangan hangat di tengah masyarakat belakangan ini.
Jawaban itu ditegaskannya, saat Rapat Bersama Komisi II Dewan Perwakilan Rakyat (DPR) RI, yang membahas permasalahan wilayah pesisir dan kepulauan.
“Kami tekankan, tanah di Indonesia, apalagi bentuknya Sertipikat Hak Milik, hanya boleh dimiliki Warga Negara Indonesia (WNI). Tidak boleh dimiliki oleh orang asing,” tegas Nusron Wahid, di Gedung Nusantara II DPR RI, Jakarta, Selasa (01/07/2025).
Menteri Nusron menjelaskan, ketentuan tersebut sesuai dengan Undang-Undang Pokok Agraria (UUPA) Nomor 5 Tahun 1960, yang secara tegas membatasi kepemilikan hak milik hanya untuk WNI. Termasuk, jika bentuknya Hak Guna Bangunan (HGB), maka status kepemilikannya wajib melalui badan hukum Indonesia, bukan badan hukum asing.
Menteri Nusron, mengingatkan, pengelolaan pulau-pulau kecil di wilayah pesisir perlu diatur agar tidak dikuasai sepenuhnya oleh pihak tertentu. Berdasarkan UU Nomor 27 Tahun 2007 juncto UU Nomor 1 Tahun 2024 tentang Pengelolaan Wilayah Pesisir dan Pulau-pulau Kecil, minimal 30 persen wilayah pulau harus tetap dikuasai negara untuk kepentingan publik, kawasan lindung, dan zona evakuasi.
“Jadi tidak boleh 100 persen pulau dimiliki satu orang atau satu badan hukum. Sebagian harus tetap menjadi milik negara dan bermanfaat untuk masyarakat luas,” tegasnya lagi.
