Manado-Satuan Reskrim Polres Talaud melaksanakan Gelar Perkara Penetapan Tersangka Tindak Pidana (TP) Pemilihan bertempat di ruangan Sat Reskrim, Senin(18/11/2024) hari ini.
Sesuai hasil Gelar Perkara ini pun orang dekat mantan Bupati Talaud dr Elly Engelbert Lasut (E2L) yang juga Calon Bupati Talaud TW bersama pasangan Cabup JA akhirnya ditetapkan sebagai tersangka.
Adapun gelar perkara didasarkan padaLP/B/201/XI/2024/SPKT/Res Tld Polda Sulut tanggal 9 November 2024 ini dipimpin Kasat Reskrim AKP Manuel Joli Bansaga,SH serta turut dihadiri oleh Komisioner Bawaslu Kabupaten Kepulauan Talaud diwakili korsek Fiktor Koropit dan Staff P3S Demis Anaada, Seksi Pengawas Polres, Seksi Propam dan Para Kanit Sat Reskrim.
Nampak juga hadir via zoom Jaksa Sentra Gakkumdu Sepriyadi, S.H yang juga diketahui menjabat Plt Kasi Pidum Kejari Kepulauan Talaud.
Adapun subjek hukum Kasus Pelanggaran Pidana Pemilihan yang melibatkan Perangkat Desa Dapihe berinisial AY saat kampanye dan telah ditetapkan menjadi tersangka ( Tsk) yakni Paslon Nomor Urut 4 berinisial TW dan JA.
” Berdasarkan alat bukti/ barang bukti yang disampaikan Penyidik dan Pemeriksaan Saksi Saksi serta pendapat peserta gelar maka Peserta gelar Perkara semuanya Setuju untuk ditingkatkan kasus ini sebagai Tersangka Terhadap subjek Hukum tersebut di atas,” ungkap Kasat Reskrim Polres Talaud.
Ditambahkan Kasat Reskrim, pada hari ini juga akan disampaikan surat penetapan tersangka dan pemanggilan sebagai tersangka.
Kedua tersangka dijerat dengan pasal 189 Jo pasal 70 ayat (1) Undang-Undang Republik Indonesia Nomor 6 tahun 2020 Tentang Penetapan Peraturan Pemerintah Pengganti Undang- Undang Nomor 2 tahun 2020 tentang Perubahan Ketiga atas Undang-Undang Nomor 1 tahun 2015 Tentang Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 tahun 2014 Tentang Pemilihan Gubernur, Bupati, dan Walikota Menjadi Undang-Undang.
Diketahui, dalam Pasal 189 Jo Pasal 70 ayat (1) berbunyi : Calon Gubernur, Calon Wakil Gubernur, Calon Bupati, Calon Wakil Bupati Calon Walikota, Calon Wakil Walikota yang dengan sengaja melibatkan pejabat badan usaha milik Negara, pejabat badan usaha milik daerah, Aparatur Sipil Negara, anggota Kepolisian Negara Republik Indonesia, anggota Tentara Nasional Indonesia, dan kepala desa atau sebutan lain/lurah serta perangkat desa atau sebutan lain/perangkat kelurahan sebagaimana dimaksud dalam pasal 70 ayat (1) dipidana penjara paling singkat 1 (satu) bulan atau paling lama 6 (enam) bulan dan/atau denda paling sedikit Rp. 600.000,- (enam ratusribu rupiah) dan atau paling banyak Rp. 6.000.000,- (enam juta rupiah).
Diketahui, sebelum ditetapkan sebagai calon Bupati, sosok TW sebelumnya merupakan Staf Khusus Bupati Kepulauan Talaud di bidang Sosial, Kebudayaan, Pendidikan, Kesehatan dan Pariwisata. Tak hanya itu, TW juga dipercayakan Bupati Talaud waktu itu Elly Engelbert Lasut sebagai Ketua Komite Perlindungan Masyarakat “Marambe” Kabupaten Kepulauan Talaud. (***/J.Mo)
