Manado-Kebijakan Menteri Dalam Negeri (Mendagri) yang mengabaikan keputusan MK nomor 62/PUU XXI/ 2023 dapat memicu kekacuan hukum jelang pesta demokrasi tahun 2024. Sebab, SK MK nomor 62 itu sudah mempunyai kekuatan hukum tetap (inkra).
Hal itu di katakan Forum Rakyat Perbatasan Talaud Pro Keadilan Nelson Entiman SH, menyikapi kebijakan Mendagri Tito Karnavian dalam memperpanjang masa jabatan Bupati Talaud Elly Engelbert Lasut dan Wakil Bupati Moktar Arunde Parapaga.
Menurut Nelson, dengan terbitnya edaran Mendagri tertanggal 28 Desember 2023 yang secara tidak langsung “mengamputasi ” putusan MK nomor 62 yang berkekuatan hukum tetap dan final itu, maka menunjukkan saat ini Mahkamah Konstitusi menjadi lembaga hukum tertinggi yang murahan dan tidak bermartabat lagi.
”Kita ketahui keputusan MK itu berkekuatan hukum tetap dan final, termasuk keputusan MK nomor 62 yang tidak dapat dibatalkan lagi, namun oleh Mendagri justru diabaikan begitu saja.” Ujar Nelson, Minggu (15/01/2024).
Dirinya menilai, proses hukum soal masa jabatan kepala Daerah yang dilantik pada tahun 2018 lalu, maka rujukan hukum yang tertinggi dan tepat adalah keputusan MK nomor 62/PUU XXI/ 2023,bukan justru berpatokan pada putusan MK No.143/PUU-XXI/2023, tanggal 21 Desember 2023.
“Mendagri harusnya tidak memasukkan Talaud dengan tujuh kepala daerah yang mengajukan gugatan ke MK,” Jelas Nelson yang juga berprofesi sebagai advokat ini.
Ia pun mendesak agar Mendagri segera mengeluarkan surat keputusan terbaru tentang penjabat Bupati Talaud.
“Karena kami melihat ada upaya yang tidak sesuai dengan aturan disini. Makanya kami minta agar Mendagri segera mengeluarkan SK tentang penjabat Bupati Talaud, yang sudah di usulkan oleh DPRD Talaud,” Jelas Nelson.
Oleh karena itu Nelson menegaskan sebagai warga Talaud akan berjuang untuk menuntut keadilan untuk mengembalikan Marwah Konstitusi sebagai lembaga tertinggi Negara.
“Negara Indonesia adalah negara hukum yang harus kita junjung bersama termasuk mentaati keputusan MK nomor 62/PUU XXI/ 2023, yang saat ini tidak di hargai dan di hormati oleh Menteri Dalam Negeri (Mendagri). Oleh karena itu kami akan berjuang dan bertemu dengan Mendagri, bahkan Presiden dan Mahkamah Konstitusi, bukan saja berjuang atas nama rakyat Talaud namun nasib dan martabat serta kehormatan bangsa ini,” Pungkas Nelson.
